EPA and State Enforcement Action Maps
EPA is responsible for enforcing all of the federal environmental laws that have been passed by Congress. Individual states are authorized to enforce certain environmental protection programs under these federal laws. Consequently, enforcement records are contained in one or more different data systems. The EPA and State Annual Enforcement Actions Map and its associated download files present the collective formal enforcement actions undertaken by both EPA and its state partners. At present, this presentation is limited to three significant environmental statutes, the Clean Air Act, the Clean Water Act, and the Resource Conservation and Recovery Act. Specifically, the map focuses on Clean Air Act stationary sources, Clean Water Act direct dischargers, and Resource Conservation and Recovery Act hazardous waste handlers (under Subtitle C) with enforcement actions taken by EPA or state regulatory agencies.
Certain programs under these statutes are not administered by the states (such as, oversight of risk management plans under Clean Air Act section 112r). Facilities with enforcement actions for these EPA-administered programs and any EPA actions that are recorded only into EPA's enforcement case database (such as leaking underground storage tank actions under Resource Conservation and Recovery Act Subtitle I) are not counted in the initial national map. After you have selected, or zoomed in to, a state map, these facilities can be displayed by checking the "Add other EPA actions" selection box. Details on these additional EPA enforcement actions are also included in the download files.
Two files can be downloaded to view the enforcement action records presented on the EPA and State Annual Enforcement Actions Map, as well as those that cannot be mapped due to missing location data.
State Downloads - After zooming in on a state from the initial national map, you can download a list of all facilities in that state that have had an enforcement action along with details about the enforcement actions. Facilities are mapped based on the location of the facility or organization that is the subject of an enforcement action. The download file includes enforcement actions from all years and all statutes, regardless of the display selection on the map. The data fields in the file allow you to sort records based on environmental statute, year, whether the actions were undertaken by EPA or the state regulatory agency, and/or whether the facilities are mapped.
Note: Facilities without locational data cannot be mapped. The download file includes enforcement actions at facilities that have location information and can be mapped, as well as those that do not have location information and are not mapped. Facilities that are not mapped have latitude and longitude fields populated with a "0" value in the download file.
National Download - The "national" download contains a list of all facilities in the U.S. that have had enforcement actions along with details about those enforcement actions. The download file includes enforcement actions from all years and all statutes. This file also includes data fields that allow you to sort records based on environmental statute, year, state, whether the actions were undertaken by EPA or the state regulatory agency, and/or whether the facilities are mapped.

The complete list of data fields included in these downloads are:
- FRS_ID - Facility Registry System (FRS) identifier. This identifier links all facility records associated with a particular location or facility and can be used to retrieve compliance records from other EPA data systems
- Name - name of the facility or organization associated with the enforcement case.
- Address - street address of organization associated with enforcement case.
- City - city in which organization associated with enforcement case is located.
- State - state in which organization associated with enforcement case is located.
- ZIP - US Postal Service Zone Improvement Plan (ZIP) code of organization associated with enforcement case.
- Latitude - latitude of organization associated with enforcement case. If value = 0, then case/facility cannot be mapped.
- Longitude - latitude of organization associated with enforcement case. If value = 0, then case/facility cannot be mapped.
- Database - indicates the database from which enforcement case was retrieved.
- AFS - Air Facility System, which stores Clean Air Act compliance information. Records are based on regulated facilities.
- ICP - ICIS-NPDES system, which stores Clean Water Act compliance information for the majority of states and territories. All states will be migrated to this system by 2012. Records are based on regulated facilities.
- PCS - Permit Compliance System, a legacy system that stores Clean Water Act compliance information for fewer than 20 states. Records are based on regulated facilities.
- ICIS - Integrated Compliance Information System, which stores information on all enforcement cases led by EPA. Records are based on enforcement cases and cover all 13 federal environmental statutes, a number of which can only be administered by EPA.
- RCRAInfo - Resource Conservation and Recovery Act Information system, which stores Resource Conservation and Recovery Act compliance information. Records are based on regulated facilities
- Statute - Federal environmental law that was violated.
- CAA< - The Clean Air Act establishes requirements to protect and improve national air quality and the stratospheric ozone layer.
- CWA - The Clean Water Act regulates discharge of pollutants into water bodies and requires plans to prevent and reduce releases, such as during storms
- RCRA - The Resource Conservation and Recovery Act regulates the handling of hazardous wastes from generation through disposal.
- Fiscal_Year - Federal fiscal year (FY) in which the enforcement action occurred. Federal fiscal years run from October 1 of the preceding calendar year through September 30 of the next calendar year. FY2010 spanned October 1, 2009 - September 30, 2010.
- Source_ID - Record identifier specific to each database.
- EPA_Action - A value of 1 indicates that a formal enforcement action was undertaken by EPA.
- State_Action - A value of 1 indicates that a formal enforcement action was undertaken by a state regulatory authority.
- Action_Date - Date the enforcement action was closed or settled. If an action has not been settled, the issued-filed date is used. Settled actions are only included if they have one of the following enforcement conclusion types:
- ACO - Administrative Compliance Orders
- AOC - Superfund Administrative Order For Cost Recovery
- APO - Administrative Penalty Order With or Without Injunctive Relief
- FFA - Federal Facility Agreement (FFA)
- FFC - Federal Facility Compliance Agreement
- FFR - Federal Facility Record of Decision (ROD)
- NPM - Non-Lead Participant in Multi-Regional Case
- CDC - Consent Decree or Court Order Resolving a Civil Judicial Action
- NLP - Non-Lead Participant in Multi-Regional Case
- Penalty_Amount - The total penalty amount associated with the enforcement action. For multi-facility enforcement cases, the total amount is presented for each facility associated with the action.
